General Terms and Conditions of Business (GTC)

 

  1. Scope

For all orders placed and contracts concluded through our shop (GRAND PINOT – owner Michael Halbritter) on Amazon Marketplace via the following or any country specific Amazon link https://www.amazon.de/s?merchant=ATKRH4WAGJMJS&fallThrough=1 and any other orders and contracts concluded (e.g. through E-Mail) with GRAND PINOT, owner Michael Halbritter, the following Terms and Conditions of Business apply between Grand Pinot – Michael Halbritter, Stuerzelberg 7, 97762 Hammelburg E-Mail: info@grandpinot.de Telephone number:  +49 (0) 15226355413, VAT identification number DE815633989, and you as the Customer.

The GTC apply regardless of whether you are a consumer, entrepreneur or merchant. All services provided by the online shop for customers are exclusively based on the following GTC. The valid version of the GTC at the time that the contract is concluded is controlling. Any deviating regulations/provisions only apply if they have been individually agreed upon between the online shop and the customer. The GTC apply regardless of whether you are a consumer, entrepreneur or merchant. The following GTC apply to all orders placed via our shop on Amazon Marketplace.

  1. Contract Partner, Conclusion of Contract

The purchase agreement is concluded with GRAND PINOT – Michael Halbritter.

The presentation of the products in the online shop or on the website is not a legally binding offer, but a non-binding online catalog. The confirmation of the receipt of your order is made via e-mail immediately after dispatch of the order and does not constitute contractual acceptance. We may accept your order by sending a declaration of acceptance in a separate e-mail within 2 days.

You have the option to complete the ordering process via the shopping cart system or 1-Click® Ordering. If you order via the shopping cart system, you have the option to change, delete or cancel your order at any time.

When ordering via 1-Click® Ordering, you may place your order without using the shopping cart. By clicking the “Buy now with 1-Click®” button, an order is automatically created, and the order is sent to the delivery address that you have stored and for which a payment is made with the specified payment method.

You can check and change your 1-Click® settings at the following link or any country/language specific amazon link: //www.amazon.de/gp/css/account/address/view.html. You also have the option to change or cancel your 1-Click® orders within 30 minutes.

The language available for the conclusion of the contract is normally German or if both parties agree on English
The contract text is not stored by us. You have the option to view your latest orders in your Amazon account at //www.amazon.de/gp/css/order-history/ (or any country/language specific amazon link referring to the order-history).

There is also the possibility for the parties to conclude a purchase contract verbally or in writing (also by e-mail).

  1. Payment
    The following payments methods are available in our shop:

Credit Card
Your credit card will be charged at the time that we the ship the goods to you.

Direct Debit
The purchase price will be debited from your account at the time that we ship the goods to you.

Separate Agreement; e.g. in case of an order by e-mail, the parties can also agree to payment by means of purchase on account or by means of pre-payment or PayPal.

  1. Retention of Title

The ordered goods remain our property until payment has been made in full.

 

  1. Damages in Transit

If the goods are delivered with obvious damages that occurred during transport, please report this immediately to the deliverer as soon as possible and contact us immediately as well. The omission of a complaint or not contacting us does not affect your statutory claim and its enforcement, in particular your warranty rights. However, you can help us with our claims against the freight carrier or in settling our claims with the insurance company that provides the insurance for the goods in transit.

 

  1. Warranty and Guarantees

 

Unless otherwise agreed upon, the customer’s statutory rights based on liability for defects apply.

In the case of used goods, the statutory period of limitation for claims for defects is one year from delivery of the goods.

The aforementioned limitations and shortening of deadlines do not apply to claims arising from damages caused by us, our legal representatives or vicarious agents:

  • in case of injury to life, body or health;
  • in case of intentional or grossly negligent breach of duty as well as fraudulent intent;
  • in case of a breach of material contractual obligations, the fulfillment of which allows for the proper execution of the contract in the first place and the compliance with which the contractual partner may regularly rely (cardinal obligations);
  • within the framework of a guarantee promise, if agreed one is agreed upon; or
  • if liability is covered under the Product Liability Act.

  1. Liability

We are always liable, without limitation, for claims due to damages caused by us, our legal representatives, or vicarious agents

  • in case of injury to life, body or health;
  • in case of intentional or grossly negligent breach of
  • within the framework of a guarantee promise, if agreed one is agreed upon; or
  • if liability is covered under the Product Liability Act.

In the case of a breach of material contractual obligations, the fulfillment of which allows for the proper execution of the contract in the first place and the compliance with which the contractual partner may regularly rely (cardinal obligations), due to simple negligence by us, our legal representatives or vicarious agents, liability is limited to the amount foreseeable at the time of conclusion of the contract that are typically expected.

In addition, claims for damages are excluded.
